*The reference in this document of dog shall be the one referred to above, the Seller shall be Redcoat Knls, (Kim Swogger).

 

*Deposits are NON-REFUNDABLE for any reason, unless by fault of the Seller, in which there was no litter or not the sex buyer wanted. If this is the case, you have the choice for a full refund or a rollover to another breeding.  Decision is final.

*Seller reserves the right to 1st picks on any litter up until pups are 8wks old. For pups that need to be shipped, puppy balance is due including shipping charges, (airfare, crate and health certificate),by the time pup is 6 wks old. It is the buyer’s responsibility to contact Seller. In the case where the puppy is past their 6 wk payment deadline and no contact has been made to us, all money paid to Seller will be forfeited.

*No sale is guaranteed and Contract is void until payment is made in full

* The Buyer agrees to have the puppy examined by a licensed veterinarian within five (5) working days from receipt of the puppy. Should the dog be determined genetically or physically in ill health, (this does not include communicable diseases or non-life threatening illness.) within 30 days of signing this agreement, the cause which is clearly attributable to Seller, the dog may be returned with a written diagnosis detailing the health problem. from a licensed Veterinarian, a full refund of purchase price of pup only, or another puppy shall be given as a replacement, whichever is mutually agreeable.  (All shipping costs are responsibility of Buyer.) Any veterinarian's diagnosis shall be subject to confirmation by a veterinarian chosen and paid for by the Seller. Should said veterinarian not concur with the diagnosis, the matter shall be presented to a third veterinarian mutually agreed upon by the Seller and the Purchaser.

*Seller shall not be liable for more than the purchase price of the puppy, should the buyer opt to keep the puppy and invest in vet care for the problem.

*Seller guarantees the dog to be current on all vaccinations and worming at the time of purchase and free of any communicable diseases.  Seller cannot be held responsible for health defects due to Buyer’s negligence regarding vaccinations after date of sale.

 

*One half of the sales price is to be forfeited if the dog is returned for any other reason than failure to pass veterinarian examination.  (All shipping costs are responsibility of Buyer.)

 

*Seller does not guarantee pups to be show quality. Seller also makes no guarantee to size or weight of dog at maturity, as this can depend on the care the dog receives which is beyond the control of the breeder.

*The name “Swogger’s” will be included within the registered name on the official registering papers and whenever and wherever the dog is mentioned in advertising, on message boards, etc.

 

*If purchasing a male dog from the Seller, buyer agrees it must allow one stud service with a waiver of any stud fee upon Seller’s request.  Seller is responsible for paying all shipping or artificial insemination fees in needed.

 

*Buyer to notify Seller on a yearly basis as to the dog’s condition, provide a current photo and advise Redcoat Kennels of any changes in address or phone number.

 

*Buyer will immediately notify Seller if dog is sold, given away, stolen or lost.

 

*Buyer agrees not to sell this puppy/dog or any of its offspring to retailers, wholesalers, or for auction or research.

 

*The Seller reserves the right to inquire about and inspect the dogs housing and quarters.  If the Seller finds the dog in an unsanitary and/or in poor health condition, the Seller has the right to take the dog back from Seller with no compensation to Buyer.

 

*Buyer will make themselves very aware of any possible bans, ordinances, etc. in their county, community, and/or country that are breed specific.  As a responsible American Pit Bull Terrier owner, Buyer must regularly check up on these possibilities as well as promote the breed in an extremely positive manner.

 

*Dogs when introduced into new surroundings are sometimes inclined to exhibit shyness and inactivity.  In some instances, they may refuse to eat.  After becoming adapted to their new environment, they will readily accept you as their new master and the food you offer.  Your care and attention will aid in overcoming the shyness of the quarters.

 

*You as the new owner have a great responsibility to maintain your dog’s emotional and physical well-being.

*Maintain a sound feeding program.

*Insure continued health by regular veterinarian check-ups.

*Maintain proper immunization and keep them up to date.

*Proper exercise for mental and physical well-being.

*The responsibility, love and care you give your dog will be returned many times in the years ahead.

 

*If for any reason buyer cannot keep this animal, buyer will contact Seller first, before selling, disposing or giving this animal away.

 

*Buyer agrees that this said puppy/dog will not be used for any inhumane, immoral, or illegal purposes.  If it is determined that Buyer has or is using said puppy/dog in this manner, Seller has the right to take back possession of said puppy/dog without compensation to Buyer.  All provisions in this contract are designed to safeguard the puppy/dog, the breed in general  APBT), and/or the community.
